US Airways’ pilots sue the company

May 31, 2011

US Airways Airbus A319-112 N745VJ (msn 1289) (Allegheny Airlines colors) CLT (Bruce Drum), originally uploaded by Airliners Gallery.

US Airways’ (Phoenix) pilots, represented by the US Airline Pilots Association (USAPA), have filed a complaint against defendant US Airways in the U.S. District Court Southern District of New York alleging that US Airways has violated its duty to maintain the status quo during contract negotiations as required by the Railway Labor Act (RLA).

In its complaint, USAPA alleges:

US Airways has unilaterally altered the parties’ collective bargaining agreements by intentionally frustrating and abrogating the contractual grievance and arbitration procedures outlined in the collective bargaining agreements.

US Airways has deliberately delayed the scheduling of disputes as required under the Railway Labor Act. It has failed to prosecute disciplinary and contractual grievances in a timely fashion and refused to complete arbitration hearings within the allotted, agreed upon time. Its actions have created a backlog of more than 500 unresolved grievances.

Lastly, US Airways has refused to follow well-established and agreed upon procedures and practices regarding the settlement of disciplinary and contractual disputes.

According to the union, US Airways has violated its obligations under the RLA to maintain the status quo with respect to terms and conditions of employment for those US Airways employees represented by USAPA.

Again, according to the USAPA, US Airways has also violated the RLA by intentionally failing to “exert every reasonable effort” to reach a settlement with USAPA regarding an integrated collective bargaining agreement. USAPA believes the defendant has bargained in bad faith in violation of the RLA by engaging in surface bargaining and employing evasive and dilatory tactics with respect to the ongoing major dispute.

US Airways has demonstrated a clear intention not to reach an agreement with USAPA regarding an integrated collective bargaining agreement, and therefore has violated the Railway Labor Act.

US Airways has committed an additional violation of the Railway Labor Act by failing to “exert every reasonable effort … to settle all disputes … arising out of the application of” the current collective bargaining agreements.

US Airways has failed to make “every reasonable effort” to settle or otherwise resolve contractual interpretation disputes in violation of the Railway Labor Act.
USAPA feels that the egregious nature of these illegal acts has been compounded by important safety grievances that remain unresolved as a result of US Airways’ actions.

In its complaint, USAPA seeks to enjoin US Airways from unilaterally abrogating and altering the relevant collective bargaining agreements pending completion of the RLA’s major dispute resolution procedure. USAPA requested that the District Court issue a preliminary injunction prohibiting US Airways from engaging in this misconduct.

Alaska Airlines issues its pilots an iPad to replace paper manuals

May 28, 2011 — 1 Comment

Alaska Airlines Boeing 737-890 WL N569AS (msn 35184) (75th Anniversary) SEA (Nick Dean), originally uploaded by Airliners Gallery.

Alaska Airlines (Seattle/Tacoma) becomes the first major airline to issue an iPad to each of its pilots. As part of an ongoing effort to use technology to enhance flight safety, improve efficiency and protect the environment, Alaska Airlines is issuing iPad tablet computers to its pilots. The 1 1/2-pound iPads replace up to 25 pounds of paper flight manuals that pilots are required to carry when they fly.

The iPads are being distributed to all Alaska Airlines pilots, a process that will be complete by mid-June. This follows a successful trial by 100 line and instructor pilots and Air Line Pilots Association (ALPA) representatives, who evaluated the feasibility of using iPads as electronic flight bags this past winter and spring.

The iPads will replace the paper manuals.

The iPads contain an app called GoodReader that is loaded with PDF versions of 41 flight, systems and performance manuals, reference cards, and other materials. The electronic manuals include hyperlinks and color graphics, enabling pilots to find information faster and easier. Updating these reference materials can now be accomplished with one tap on the iPad screen instead of the former, labor-intensive process of replacing individual pages with new ones. The iPad is considered a Class 1 electronic device, meaning it is stowed during takeoff and landing under Federal Aviation Administration regulations.

In conjunction with replacing paper manuals, Alaska Airlines is exploring the replacement of paper aeronautical navigation charts with electronic versions on the iPad, eliminating the need for every pilot to carry their own copy. The two initiatives, dubbed “Bye, Bye, Flight Bag,” will save about 2.4 million pieces of paper.

The cost of the project is expected to be offset by lower paper, printing and distribution expenses and reduced fuel consumption as some weight is removed from the aircraft. Further savings are expected from fewer back and muscle injuries caused by pilots carrying flight bags that can tip the scales at 50 pounds or more fully loaded.

Korean Air (Seoul-Incheon) today (May 24) celebrated the delivery of its first A380 at a special ceremony at Airbus in Toulouse. The ceremony was attended by Korean Air Chairman Yang Ho Cho and hosted by Airbus President and CEO Tom Enders. EADS CEO Louis Gallois was also present at the event. Korean Air is the sixth airline to take delivery of the A380 and has ordered a total of 10 aircraft.

Korean Air will initially operate the A380 from its Seoul hub to selected destinations in Asia, followed by nonstop services to North America and Europe.

Korean Air will be the first Airbus A380 customer to dedicate the entire upper deck of the aircraft to Prestige (business) Class passengers with 94 lie-flat Prestige Class seats. It is also the first airline in the industry to have a “Duty Free Showcase” on the A380 aircraft. The unique feature will have a variety of duty-free products displayed with a dedicated cabin crew member on hand to assist and advise passengers with their shopping.

Korean Air will also become the first Asian carrier to operate the GP7200 engine.

The GP7200 engine is the leading engine for the Airbus A380 aircraft.  It has been selected to power 56% of all A380s on order with engine selections.  There are 20 GP7200-powered A380s in service and 104 more on order.

In addition to Korean Air, Emirates and Air France operate GP7200-powered A380 aircraft.  Etihad and Air Austral have also selected GP7200 engines for their A380 fleets.

According to the manufacturer, “the Engine Alliance is a 50/50 joint venture of General Electric and Pratt & Whitney, a unit of United Technologies Corporation. The GP7200 is the result of innovations to the combined technologies of its member companies’ most successful wide-body engines: the GE90 and the PW4000. The GP7200 utilizes the lessons learned from more than 35 million flight hours of successful operation with these legacy engines and incorporates new technology to produce the quietest, most fuel efficient engine for the A380.  The GP7200 is certified at 76,500 pounds (340 kN) of thrust and has the capability to produce more than 81,500 pounds (363 kN). Its emissions are well below current and anticipated regulations.”

GP7200 Engine Program participants include SNECMA (France), Techspace Aero (Belgium) and MTU Aero Engines (Germany).

Jazz paints two aircraft with Advanced PPG Aerospace “Green” System

May 24, 2011

Jazz Aviation LP (Halifax) has repainted two Bombardier DHC-8-102 aircraft with an advanced “green” coatings system by PPG Industries. According to the company, “this chromate-free PPG coatings system reduces environmental impact, lowers weight, and provides a smooth, glossy and highly durable finish”.

The two Jazz airplanes were repainted by Springer Aerospace, Sault Ste. Marie, Ontario, with DESOTHANE(R) HD/CA 9000 basecoat/clearcoat, DESOPRIME(TM) CF/CA 7502 epoxy primer and DESOGEL(TM) EAP-9 metal pretreatment, all from PPG.

Jazz is the first airline in Canada to specify the complete green PPG system.

The PPG coatings system consists of a heavily pigmented basecoat and a clear topcoat. Using DesothaneHD/CA 9000 basecoat/clearcoat can reduce painting cycle process time by up to one full day because the fast-drying basecoat provides color in one coat, as compared with two or three coats in a typical system.

Delta and US Airways announce a new agreement to transfer slots in New York and Washington

May 23, 2011

US Airways Express-Mesaba Airlines SAAB 340B N402XJ (msn 402) IAD (Brian McDonough), originally uploaded by Airliners Gallery.

Delta Air Lines (Atlanta) and US Airways (Phoenix) today (May 23) announced a new agreement to transfer takeoff and landing rights at New York’s LaGuardia and Washington’s Reagan National airports. The agreement, filed today with the Federal Aviation Administration (FAA), revises a 2009 transaction agreed between Delta and US Airways and approved by the DOT, but under terms not acceptable to the carriers, and never completed. The new agreement enables Delta and US Airways to expand service and increase competition at two of the nation’s key cities, and provides the opportunity for additional access to LaGuardia and Reagan National for new entrants and airlines with a limited presence at the airports.

Under the agreement, Delta would acquire 132 slot pairs at LaGuardia from US Airways and US Airways would acquire from Delta 42 slot pairs at Reagan National and the rights to operate additional daily service to Sao Paulo, Brazil in 2015, and Delta would pay US Airways $66.5 million in cash. In addition, the transaction could result in the divestiture of up to 16 slot pairs at LaGuardia and eight slot pairs at Reagan National to airlines with limited or no service at those airports. The completion of the transaction is subject to certain closing conditions, including government and regulatory approvals. A slot pair is the authority to operate one takeoff and one landing.

Both carriers believe the competitive landscape in both cities has changed significantly since the transaction was first proposed in 2009. New entrants and smaller carriers, including AirTran Airways, JetBlue Airways and Southwest Airlines, have gained considerable access to slots at both LaGuardia and Reagan National and expanded service at these and other airports in the New York and Washington regions. Also, mergers between United Airlines and Continental Airlines and Southwest and AirTran have dramatically sharpened competition on the East Coast generally and particularly in the New York and Washington regions. Nonetheless, to address concerns previously raised by the Department of Transportation, the agreement provides for the divestiture of up to 16 slot pairs at LaGuardia and eight at Reagan National if required by the regulatory authorities.

The two airlines will dismiss their appeal of the DOT’s order regarding the original 2009 transaction that is currently pending in the U.S. Court of Appeals in Washington. Dismissing the appeal clears the way for DOT to consider the revised application.

Delta’s expanded operation at LaGuardia will allow more and improved connecting service in New York, and ensure economically viable service to small communities, while creating an expanded network that will be particularly valuable for New York business customers. The airline will approximately double the number of nonstop destinations it serves from LaGuardia, including top business destinations and many cities not currently served nonstop by Delta or US Airways.

Delta will replace turboprop aircraft currently operated by US Airways with larger jets, adding as many as 4 million additional roundtrip seats available at LaGuardia without increasing congestion.

As part of the agreement, Delta will take control of US Airways’ Terminal C to create an expanded main terminal for customers. Delta will operate a total of 18 gates in Terminal C, and add one additional gate at Delta’s Terminal D, for a total of 29 gates in the two terminals. A 600-foot connector will be built to connect the two terminals. Delta also will convert the existing US Airways lounge in Terminal C to a Sky Club, while continuing to operate its current Sky Club in Terminal D.

Delta will continue to operate its popular hourly Delta Shuttle from its six gates at the Marine Air Terminal. In addition, Delta will spend up to $117 million to expand, renovate and consolidate terminals C and D over the next two years. Overall, the transaction will directly and indirectly generate an estimated 6,000 new jobs in New York.

Since making a strategic decision to build New York into a hub earlier this decade, Delta has made major investments across the region, boosting its economic impact to more than $13 billion annually. The airline is currently constructing a $1.2 billion project that will enhance and expand Terminal 4 at John F. Kennedy International Airport, creating a state-of-the-art facility for New York’s fastest growing global airline.

US Airways’ popular hourly Shuttle service between LaGuardia, Reagan National and Boston that is operated on dual-class mainline jets will remain unchanged as a result of the transaction. Also, US Airways will continue to offer its customers high-frequency schedules from LaGuardia to its Charlotte, N.C. and Philadelphia hubs and Pittsburgh with more than 60 daily weekday flights. All US Airways flights from LaGuardia will continue to arrive and depart from nine gates and parking positions in Terminal C and US Airways will build a new, state-of-the-art 5,000-square foot US Airways Club.

At Reagan National, US Airways’ expanded operation will connect more small, medium and large communities with the nation’s capital and create additional flight options throughout the airline’s route network. US Airways expects to further increase its use of dual class mainline aircraft and soon to be dual class larger regional jets at Reagan National. The move will benefit customers by increasing the number of available seats between Washington and favorite destinations without increasing congestion.

US Airways plans to add at least 15 new destinations from Washington, to its network as a result of the transaction and competition will be further enhanced by US Airways adding service to popular destinations that are currently served by other carriers. As a result, business and leisure travelers as well as military and government employees will have more access to the nation’s capital and its downtown airport.

Following full implementation of the new schedule, US Airways will operate approximately 230 peak-day departures at Reagan National, a 20 percent increase over current service levels. The airline anticipates an increase of approximately 20 to 25 percent in passenger enplanements at Reagan National as a result of the new flights and schedule improvements. However, there will be no increase in congestion at the airport due to US Airways’ planned increase in scale and Delta’s reduction in slots.

The expansion is consistent with US Airways’ previously announced strategic plan to focus on growing its key, most profitable airports at its Washington focus city, its Phoenix, Philadelphia and Charlotte hubs and its US Airways Shuttle service. Once the transition is complete, more than 99 percent of US Airways capacity will be to or from its key airports.

Delta will continue to operate a robust schedule at Reagan National, with nonstop service between the airport and its seven domestic hubs and select cities. It also will continue to operate its Delta Shuttle between Reagan National and New York.

The Battle for New York: Is Delta winning the battle?

Delta Air Lines (Atlanta) is close to finalizing another slot swap attempt with US Airways. If approved, Delta could take over about half of the slots at New York’s LaGuardia Airport according to this article by Bloomberg in the San Francisco Chronicle. If successful, the swap would give Delta an advantage over American Airlines (Dallas/Fort Worth) and other U.S. carriers in the world’s busiest aviation market, especially for the high-yield markets.

Delta may double its daily LaGuardia departures under a proposed trade agreement giving DL most of the slots held by US Airways (Phoenix). A final agreement could come within weeks.
